By accessing or using Pikks, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service.

2. Description of Service

Pikks provides a platform for organizing and participating in Super Bowl Squares pools. Our service includes:

• Creating and managing Super Bowl Squares pools
• Purchasing squares using secure payment processing
• Viewing pool grids and tracking results
• Managing your account and balances

3. Eligibility

You must:

• Be at least 18 years old
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using our service under applicable laws
• Comply with all local laws regarding online gaming and gambling

Note: Super Bowl Squares may be subject to gambling laws in your jurisdiction. You are responsible for ensuring your participation is legal in your location.

4. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account
• You must notify us immediately of any unauthorized use
• One person may not create multiple accounts
• We reserve the right to suspend or terminate accounts that violate these terms

5. Payments and Refunds

5.1 Purchasing Squares

• All payments are processed securely through Square
• Prices are displayed in USD and include all applicable fees
• Payment must be completed before squares are reserved
• We do not store your full credit card information

5.2 Refund Policy

• Refunds are generally not available once squares are purchased
• Exceptions may be made for technical errors or duplicate charges
• Refund requests must be submitted to support@pikks.com
• We reserve the right to issue refunds at our discretion

5.3 Winnings and Payouts

• Winnings are calculated according to the pool rules
• Payouts are processed within 7 business days after the Super Bowl
• You must provide valid payment information to receive winnings
• Unclaimed winnings after 90 days may be forfeited

6. Pool Rules

• Each pool may have specific rules set by the pool creator
• You agree to abide by the rules of any pool you join
• Numbers are randomly assigned after all squares are sold
• Pool results are determined by official NFL game scores
• Disputes will be resolved by the pool administrator

7. User Conduct

You agree NOT to:

• Use the service for any illegal purpose
• Attempt to manipulate or cheat the system
• Create fake accounts or impersonate others
• Interfere with the proper functioning of the service
• Use automated systems (bots) to interact with the service
• Harass, abuse, or harm other users
• Share your account credentials with others

8. Intellectual Property

All content, features, and functionality of Pikks are owned by us and protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute our content without permission
• Reverse engineer or decompile our software
• Remove any copyright or proprietary notices
• Use our trademarks without written permission

NFL, Super Bowl, and related marks are trademarks of the National Football League. This service is not affiliated with or endorsed by the NFL.

9. Disclaimers and Limitations of Liability

9.1 Service "AS IS"

Our service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Uninterrupted or error-free operation
• Accuracy or reliability of information
• Security of data transmission

9.2 Limitation of Liability

To the maximum extent permitted by law, Pikks shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Service interruptions or errors
• Actions of other users
• Third-party services (payment processors, social login providers)

Our total liability shall not exceed the amount you paid us in the past 12 months, or $100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless Pikks, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Your participation in pools

11. Termination

We may suspend or terminate your account:

• For violation of these Terms
• For fraudulent or illegal activity
• At our discretion, with or without notice
• If required by law

You may delete your account at any time through your account settings. Upon termination, your right to use the service ceases immediately.

12. Dispute Resolution

12.1 Informal Resolution

If you have a dispute, please contact us at support@pikks.com and we will attempt to resolve it informally.

12.2 Arbitration

Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or class-wide arbitration.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Sending an email notification (for significant changes)

Continued use of the service after changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
